Terms of Service

These Terms of Service ("Terms") govern your access to and use of the RentPermit website at rentpermit.com and the RentPermit application (collectively, the "Service"), operated by RentPermit ("RentPermit," "we," "us," or "our"). By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Description of the Service

RentPermit is a software-as-a-service platform that helps short-term rental hosts track permit renewals, monitor compliance deadlines, and stay organized with regulatory requirements for their rental properties. The Service provides informational tools and reminders. It does not constitute legal advice, and nothing in the Service should be construed as legal advice. Permit requirements, regulations, and deadlines vary by jurisdiction and change over time. You are solely responsible for verifying the accuracy and currency of any regulatory information you rely on, whether obtained through the Service or otherwise.

Accounts and Registration

To use the Service, you must create an account by providing your name, email address, and a password. You must be at least 18 years old to create an account. You agree to provide accurate, current, and complete information during registration and to update this information to keep it accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@rentpermit.com if you suspect unauthorized use of your account. We are not liable for any loss or damage resulting from unauthorized access to your account that occurs through no fault of our own.

One account corresponds to one user. You may not share your account credentials with others or create accounts on behalf of others without their express consent.

Subscriptions and Billing

RentPermit is offered on a subscription basis. Current pricing is displayed on the pricing page at rentpermit.com. New accounts receive a 14-day free trial. No credit card is required to start a trial. After the trial period ends, continued use of the Service requires a paid subscription.

Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select. All payments are processed by Stripe. By providing payment information, you authorize us to charge your payment method for the applicable subscription fees. All fees are in US dollars. Fees are non-refundable except as expressly stated in these Terms or as required by applicable law.

We may change our subscription fees at any time. We will provide at least 30 days' advance notice of any price increase by email. Your continued use of the Service after the price change takes effect constitutes your agreement to pay the updated fees.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will continue to have access to the Service through the end of the billing period for which you have already paid. We do not provide prorated refunds for partial billing periods.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service to store false or misleading information, to impersonate any person or entity, to engage in any activity that interferes with or disrupts the Service or the servers and networks connected to the Service, or to attempt to gain unauthorized access to any portion of the Service or its related systems.

You agree not to reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the Service. You agree not to scrape, crawl, or systematically extract data from the Service using automated means. You agree not to use the Service to develop a competing product or service.

Your Content and Data

You retain ownership of all property data, permit information, and other content you enter into the Service ("Your Content"). By entering Your Content into the Service, you grant RentPermit a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Service to you.

You are responsible for the accuracy of Your Content. RentPermit does not verify the accuracy of permit numbers, dates, or other regulatory information you enter. The Service is a tracking and reminder tool and does not independently confirm whether your permits are valid or whether you are in compliance with applicable regulations.

Intellectual Property

The Service, including its design, code, features, and all content created by RentPermit (excluding Your Content), is owned by RentPermit, and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service other than the limited right to use it in accordance with these Terms.

The RentPermit name and logo are trademarks of RentPermit, You may not use our trademarks without our prior written consent.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, RENTPERMIT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

RENTPERMIT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. RENTPERMIT DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR CURRENCY OF ANY REGULATORY INFORMATION PROVIDED THROUGH THE SERVICE. PERMIT REQUIREMENTS CHANGE FREQUENTLY AND YOU ARE RESPONSIBLE FOR INDEPENDENTLY VERIFYING ALL REGULATORY REQUIREMENTS APPLICABLE TO YOUR PROPERTIES.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RENTPERMIT, AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, FINES, PENALTIES, OR REGULATORY SANCTIONS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF RENTPERMIT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL RENTPERMIT'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO RENTPERMIT IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.

Indemnification

You agree to indemnify, defend, and hold harmless RentPermit, and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.

Termination

You may stop using the Service at any time and cancel your account through your account settings. We may suspend or terminate your account at any time if we believe you have violated these Terms, if your account has been inactive for more than 24 months, or for any other reason with 30 days' notice by email.

Upon termination of your account, your right to use the Service ceases immediately. We will delete your personal data in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination will survive, including sections on intellectual property, disclaimers, limitation of liability, and indemnification.

Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration will take place in Delaware. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

You waive any right to participate in a class action lawsuit or class-wide arbitration. You may only bring claims against RentPermit in your individual capacity.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and by updating the "Last updated" date at the top of this page at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service before the effective date.
