What is a short-term rental permit?
A short-term rental (STR) permit is a license issued by a local government that authorizes a property owner to rent their home or unit to guests for periods typically under 30 days. In the US, STR regulation is handled at the city or county level — there is no federal STR permit.
Most major US cities now require some form of STR permit or registration. The specific requirements, fees, and consequences for non-compliance vary significantly by jurisdiction. Operating without a valid permit exposes hosts to substantial fines and platform delisting.
Who needs an STR permit?
If you rent a property on Airbnb, VRBO, or any other platform for fewer than 30 days at a time in a major US city, you almost certainly need a permit. This applies to:
- Entire-home rentals in regulated cities
- Room rentals in your primary residence
- Investment properties rented short-term
- Occasional rentals (in most cities, there is no minimum number of nights below which a permit is not required)
A small number of cities allow occasional rentals without a permit but require registration above a certain threshold. Check your specific city's ordinance for details.
What do STR permits require?
While requirements vary by city, most STR permit applications require some combination of the following:
- Proof of ownership or lease: A deed, property tax record, or lease agreement showing you have the right to rent the property.
- Primary residence proof: Cities including Denver, Nashville, and Los Angeles require hosts to live at the property. A utility bill, driver's license, or voter registration card is typically accepted.
- General liability insurance: Most cities require a minimum of $1 million in general liability coverage. Some, including Jersey City, require $2 million.
- Floor plan: Some cities require a floor plan of the rental unit showing room layout, number of bedrooms, and square footage.
- Safety inspection: Denver, Chicago, and Portland require a licensed inspector to certify working smoke detectors, carbon monoxide detectors, fire extinguishers, and egress.
- Neighbor notification: Austin and some California cities require you to notify adjacent property owners of your STR application.
- HOA approval: If your property is in a condo or HOA community, many STR ordinances require written confirmation that your association permits short-term rentals.
How to get a short-term rental permit
Check your city's STR regulations
Search "[your city] short-term rental ordinance" or "[your city] STR permit." Most cities have a dedicated page on their official website. Confirm whether your property zone allows STRs — some residential zones prohibit them entirely.
Gather required documents
Proof of ownership, ID, primary residence proof (if required), insurance certificate, floor plan, and any inspection reports. Incomplete applications are typically returned and pushed to the back of the queue.
Schedule a safety inspection if required
If your city requires an inspection, schedule it with a licensed inspector before submitting your application. Inspection reports are often only valid for 90 days, so time this appropriately.
Submit your application and pay the fee
Most cities now have online portals. Application fees range from $25 (Denver) to over $600 (Austin). Processing time ranges from a few business days to several months in high-volume cities.
Add your permit number to your listings
Once approved, add your STR permit or license number to your Airbnb and VRBO listings immediately. In cities like Austin, Portland, and San Antonio, platforms are required to verify and delist listings without a valid permit number.
Set a renewal reminder before your permit expires
Most STR permits require annual renewal. Cities do not send reminders. Missing your renewal date exposes you to the same fines as operating without a permit. RentPermit sends email alerts at 60, 30, and 7 days before expiry — free for 14 days.
STR permit requirements by city
The table below summarizes permit requirements for major US cities as of early 2026. Regulations change frequently — always verify with your city's official website.

Night caps: how many nights can you rent?
A growing number of US cities limit the total number of nights an STR can be rented per calendar year. These limits, called night caps, are designed to reduce the impact of STRs on long-term housing supply.
Cities with night caps
- Portland, OR: Unhosted rentals are capped at 95 nights per calendar year. Hosted rentals (where the owner is present) have no cap.
- Los Angeles, CA: Unhosted rentals are limited to 120 nights per year. Additional nights require city approval.
- Palm Springs, CA: Hosts are limited to 26 rental contracts per calendar year, regardless of total nights.
- San Francisco, CA: Unhosted rentals are limited to 90 nights per year.
Tracking your night cap
Exceeding your city's night cap can result in permit revocation and significant fines. Cities do not notify you when you are approaching your limit. You are responsible for tracking your own rental nights.
RentPermit's night cap counter tracks your booked nights in real time, either through Airbnb and VRBO calendar sync or manual booking entry. A visual progress bar shows how close you are to your city's limit.
What happens if your STR permit lapses?
Operating an STR without a valid permit, or after your permit has expired, can result in significant penalties.
| City | Fine for operating without permit |
|---|---|
| Austin, TX | $500/day per violation |
| New York City, NY | Up to $5,000 per violation |
| Portland, OR | $500-$1,000/day |
| San Antonio, TX | Up to $2,000/day |
| Denver, CO | $150-$999 per violation |
| Chicago, IL | $1,500-$3,000 per day |
| Los Angeles, CA | $2,000 per violation |
Beyond fines, platforms including Airbnb and VRBO are now required to delist listings in cities that mandate permit number display. A lapsed permit can mean your listing disappears overnight, losing all future bookings.
Renewing your STR permit
Most STR permits require annual renewal. The renewal process is typically simpler than the initial application — in many cities, it's an online form and payment with no re-inspection required unless conditions have changed.
Renewal timelines by city
- Austin: Annual renewal, typically 30-60 days before expiry date. Renewal fee similar to initial fee.
- Denver: Annual renewal, processed online through Denver's MyDenver portal.
- Portland: Annual renewal required. Re-inspection may be required every 2 years.
- Chicago: Annual renewal through Chicago's business license portal.
- Houston: Annual renewal, introduced with the 2026 ordinance.
Why cities don't remind you
Cities send renewal notices inconsistently, if at all. Budget cuts, system limitations, and high permit volumes mean many hosts receive no notification that their permit is expiring. The responsibility for tracking renewal dates sits entirely with the host.
RentPermit emails you automatically at 60 days, 30 days, and 7 days before each permit expiry date. You can track multiple permits across multiple properties from a single dashboard. Start a free 14-day trial.
